Judge denies Harvey Weinstein’s new request as sexual assault conviction stands

A New York judge has denied Harvey Weinstein’s request for a new trial, leaving intact his 2025 sexual assault conviction stemming from his Manhattan retrial. Harvey Weinstein, 73, was found guilty in June 2025 of one count of committing a criminal sex act against former television production assistant Miriam Haley.

The verdict followed weeks of testimony and jury deliberations that resulted in a split outcome. Weinstein was acquitted on a separate charge involving former model Kaja Sokola, while jurors were unable to reach a unanimous decision on a third allegation that accused him of raping actress Jessica Mann.

After the verdict, Weinstein’s legal team filed a motion seeking a new trial, arguing that juror misconduct had tainted the deliberations. The defense claimed that there was shouting and bullying among jurors, which they said compromised the fairness of the process.

That request was rejected during a court appearance on Thursday, January 8, when a New York State Supreme Court judge ruled that the issue had been properly addressed at the time and did not interfere with the jury’s ability to deliberate independently. In a written decision reviewed by People, the judge concluded that the court handled juror concerns appropriately and without influencing the outcome.

Weinstein, who has consistently denied assaulting anyone, again told the court that he was innocent. While acknowledging what he described as personal and moral failings, he insisted he never committed sexual assault and asked the judge for leniency, according to AP News.

The unresolved charge involving Mann remains a major legal issue for the former producer. Weinstein was originally convicted of raping her in 2020, but that conviction was later overturned on appeal, leading to the 2025 retrial. Manhattan District Attorney Alvin L. Bragg Jr. has said prosecutors plan to retry Weinstein on that count.

Weinstein is currently being held at Rikers Island, where he told the court his continued incarceration has taken a serious toll on his physical and mental health. He has previously undergone emergency heart surgery while in custody and has reportedly been diagnosed with bone marrow cancer.

In addition to the New York case, Weinstein is already serving a separate 16-year prison sentence in California following his 2022 rape conviction there. That sentence remains in effect, regardless of the outcome of the remaining New York charge.

The judge’s decision ensures that Weinstein’s 2025 conviction will stand, at least for now, as prosecutors prepare for the possibility of another trial on the unresolved count.
